TITLE III


Chapter 1 -- nationality at birth and by collective naturalization

301 nationals and citizens of the united states at birth
302 persons born in Puerto Rico on or after April 11, 1899
303 persons born in the canal zone or republic of Panama on or after February 26, 1904
304 persons born in Alaska on or after march 30, 1867
305 persons born in Hawaii
306 persons living in and born in the virgin islands
307 persons living in and born in Guam
308 nationals but not citizens of the united states at birth


CHAPTER 1-NATIONALITY AT BIRTH AND BY COLLECTIVE NATURALIZATION
301 NATIONALS AND CITIZENS OF THE UNITED STATES AT BIRTH
SEC. 301. [8 U.S.C. 1401] The following shall be nationals and citizens of the United States at birth:
(a) a person born in the United States, and subject to the jurisdiction thereof;
302 PERSONS BORN IN PUERTO RICO ON OR AFTER APRIL 11, 1899
SEC. 302. [8 U.S.C. 1402] All persons born in Puerto Rico on or after April 11, 1899, and prior to January 13, 1941, subject to the jurisdiction of the United States, residing on January 13, 1941, in Puerto Rico or other territory over which the United States exercises rights of sovereignty and not citizens of the United States under any other Act, are hereby declared to be citizens of the United States as of January 13, 1941. All persons born in Puerto Rico on or after January 13, 1941, and subject to the jurisdiction of the United States, are citizens of the United States at birth.


Lo interesante de la SEC 302 [8 U.S.C. 1402] es lo siguiente: Toda persona nacida en Puerto Rico en o después de enero 13 de 1941 cesa de ser parte de lo llamado "naturalización colectiva" y es reconocido como un ciudadano nativo de los Estados Unidos, o sea, nacido en los Estados Unidos. Esto es algo muy importante y algo que pocos se han dado cuenta o no entienden sus grandes ramificaciones legales. Lo principal es que esa ciudadanía "natural" no se puede alterar de ninguna forma y el que la carga se la puede dejar a sus "herederos". Así es que tanta "habladera" por aquellos que se creen que saben pero jamás ven que el puertorriqueño es un americano "natural" por casi 70 años. Esa es una de las grandes razones que será un gran obstáculo para que el Congreso haga a Puerto Rico independizado. Eso dejaría a la mayoría de puertorriqueños todavía dejándole su ciudadanía americana a sus hijos en perpetuidad en una tal nación puertorriqueña del futuro.
